- Legal and Regulatory Obligations: We may be required to disclose your information to authorities, regulatory bodies, or law enforcement agencies when necessary for fraud prevention, to comply with a legal obligation (such as a court order), or to protect the rights, property, or safety of our business, our clients, or others.
Simple will only share the minimum data needed. When we disclose data under legal obligation, we have no control over how the receiving authority processes, uses, or retains that data. Such use is governed solely by that authority’s own legal frameworks and privacy policies that are outside Simple’s control.
Retention of Your Data
We collect and process various personal and company data through our website’s inquiry and contact forms. We commit to retaining this data only for as long as is strictly necessary to fulfill the specific purposes for which it was collected (such as responding to inquiries, onboarding new clients, processing payments, and issuing invoices) and to satisfy our legal, accounting, and reporting requirements.
Retention Periods
- Active Client Data: If you become a client, the data provided is necessary for contractual purposes, project management, and invoicing. We retain this data for the duration of the active business relationship and for a subsequent period of minimum 11 years after the termination of the contract or the last business interaction. This extended period is necessary to comply with mandatory national and international tax, audit, and financial reporting laws. - Sales Leads and Initial Inquiries: If you contact us regarding potential design services but do not immediately engage us as a client, we will process your data based on our legitimate interest in business development and future prospecting. We may retain your inquiry details (name, contact info, company info) for up to 24 months from our last communication. This allows us to periodically check back regarding potential future collaborations. We have determined that this processing is reasonable and expected within a B2B context and is necessary for our business growth (future clients who need time to secure budget for their project). However, you maintain the right to object to this processing at any time. If you explicitly inform us that you are not interested in our future services or wish Simple to terminate all communication with you, we will securely delete your legally non-required data, and will promptly ensure you are not contacted again.
- Newsletter Subscriptions: If you specifically consent to receive marketing communications, we retain your personal data until you exercise your right to unsubscribe. Upon unsubscribing, your personal data is removed from our newsletter list to prevent future unwanted communication. You can unsubscribe through “unsubscribe” link in our newsletters, or if you wish Simple to help remove your personal data from newsletter’s list, please send request from an e-mail address you used to subscribe to Simple’s newsletter – send “unsubscribe me” e-mail request on help@studiosmpl.com – a reason for unsubscribing is appreciated but optional.
We may retain information for periods extending beyond the standard retention limits where a specific legal obligation or compelling legitimate interest exists. This includes data necessary for auditing or reporting, or when needed for the establishment, exercise, or defense of legal claims, such as fraud prevention, debt collection, ongoing litigation, or the preservation of evidence. In such exceptional cases, relevant data is retained until the legal matter is fully resolved or the statute of limitations expires.
